His body was discovered the next morning by the boat's captain, officers said.
Police are also investigating Tichelman in connection with a similar incident in another state, the Santa Cruz deputy police chief, Steve Clark said.
"There's a pattern of behaviour here where she doesn't seek help when someone is in trouble," he said.
Assistant district attorney Rafael Vazquez said authorities are still investigating the case and may file more serious charges.
Mr Hayes, a father of five, had worked for several leading technology firms including Apple and Sun Microsystems.
NOTORIOUS: Tichelman is being investigated for a similar
incident
Tichelman was arrested on July 4 after a detective posed as a client and lured her to Santa Cruz.
An agreement was reached on a price of more than $1000 (£583) for her services.
Police said Tichelman, who boasted she had more than 200 clients, met her male customers throughout the website, SeekingArrangement.com.
The website connects wealthy "sugar daddies" with attractive "sugar babies" for a "mutually beneficial relationship".
The site lists the perks for a sugar baby as financial stability, shopping sprees, expensive dinners and exotic travels.
